Launch Café Terms of Use

First draft of 5 November 2026, English working translation of MCP/docs/gebruiksvoorwaarden.md (Dutch original; keep both in sync). Not a final text: it is a basis for a lawyer. Everything marked [VERIFY] is a choice or question for Amber or the lawyer. Remove this note and the markers when publishing.

1. Who and what

These terms apply to the use of Launch Café, a connection (https://mcp.launchcafe.be) that lets an AI assistant (such as Claude) get to know the customer's business and remember fixed working methods for marketing tasks, hereinafter "the service".

Provider: BV Amber Aspeslagh, trading as Launch Café [VERIFY: correct entity and trade name], company number 1027.880.690, Leernsesteenweg 329, 9800 Deinze, Belgium, info@launchcafe.be, hereinafter "Launch Café".

Customer: the business that uses the service, hereinafter "the customer". The service is intended for businesses, not for consumers. [VERIFY: confirm, consumer rules are stricter]

For other services of the company (web design, advertising, ...) the general terms agreed for those services apply. In case of conflict these terms prevail as far as the service is concerned. [VERIFY]

2. The service

2.1. Launch Café stores a company profile, working methods and earlier versions for the customer, and makes them available to the AI assistant the customer connects. Launch Café may send tips. Nothing is changed or stored without the customer's confirmation in the conversation.

2.2. Launch Café owes a best-efforts obligation. What the AI assistant produces (posts, plans, texts) is a first version. The customer checks it for facts, prices, tone and legal requirements before using it, and remains responsible for what they publish.

2.3. Launch Café does not guarantee that the service works without errors or interruptions, but makes reasonable efforts to keep it as available as possible. Maintenance may briefly interrupt the service.

2.4. The AI assistant itself (Claude) is a third-party service with its own terms. Launch Café is not responsible for it. The customer needs their own account and subscription with that provider.

3. Access and account

3.1. The customer gets access by signing in with Google or through a personal link with a key. The customer keeps the key secret, shares access only with people who are allowed to work on the customer's behalf, and reports loss or misuse immediately to info@launchcafe.be.

3.2. The customer is responsible for actions taken through their account.

3.3. Launch Café may suspend access in case of misuse, non-payment or breach of these terms, after a warning unless urgent security reasons rule this out.

4. The customer's data

4.1. The customer remains the owner of what they enter themselves (company profile, own working methods). The customer gives Launch Café the right to store and use that data to provide the service, send tips and improve the service, without disclosing it to other customers by name or with recognisable details. [VERIFY: whether lessons may be used anonymously across customers]

4.2. The customer does not put personal data of third parties (for example their own customers) or sensitive data in the profile or working methods. If that happens anyway, Launch Café deletes it on first request.

4.3. For the personal data of the customer (the entrepreneur and staff), Launch Café is the controller; see the privacy policy. If the content entered contains personal data and Launch Café acts as processor for it, section 9 applies.

5. Intellectual property

5.1. The working methods Launch Café provides (the base versions) and the service itself remain the property of Launch Café. The customer receives a non-exclusive, non-transferable right of use for as long as the agreement lasts.

5.2. The customer's changes to their own versions, and the working methods they create themselves, remain the customer's. Launch Café may use them for the service (section 4.1).

5.3. The customer may freely use what the AI assistant produces for them, as far as the AI provider's terms allow.

6. Price and payment

Prices or a reference to the quote or subscription, payment term and late payment go here. [VERIFY: is the service currently free, a trial or paid? There is no invoicing in the code. For now Launch Café is free during the pilot]

7. Term and termination

7.1. The agreement starts at the first connection and runs for an indefinite period. [VERIFY: whether a fixed term or trial period applies]

7.2. Either party may terminate with a notice period of [VERIFY: e.g. 30 days or end of the month] by e-mail.

7.3. Launch Café may terminate immediately in case of serious breach, bankruptcy, insolvency or misuse. [VERIFY]

7.4. After the end, the customer receives a copy of their data on request. Launch Café then deletes all of the customer's data within 30 days, except what the law requires to be kept. Backups disappear at most 5 days later. [VERIFY: align with the backup policy]

8. Liability

8.1. Launch Café's liability is limited to the amount the customer paid for the service in the past [VERIFY: 12] months, or to [amount] if the service is free.

8.2. Launch Café is not liable for indirect damage, lost profit, loss of data, damage caused by content the AI assistant produces, damage caused by outages at Anthropic, Google or other third parties, or by incorrect use by the customer or third parties (for example hacking beyond our control).

8.3. These limitations do not apply in case of intent or gross negligence by Launch Café, or to liability the law cannot exclude. [VERIFY: the lawyer decides whether this is needed]

8.4. The customer reports complaints in writing within [VERIFY: 14] days after they discovered, or should have discovered, the error.

9. Data protection (processor clause)

9.1. The privacy policy describes how Launch Café processes personal data. It forms part of these terms.

9.2. As far as Launch Café processes personal data on the customer's behalf, it acts only on the customer's written instructions (this agreement), keeps the data confidential, takes appropriate security measures, helps the customer with requests from data subjects, reports a data breach within 48 hours [VERIFY: period] and deletes or returns the data at the end (section 7.4).

9.3. Launch Café may use subprocessors (Fly.io, Auth0, Google; see the privacy policy) and imposes equivalent obligations on them. A list is available on request. If there is a new subprocessor, the customer may object; in that case the customer may terminate.

9.4. Whether a separate data processing agreement under Art. 28 GDPR is needed besides this section is for the lawyer to decide. [VERIFY]

10. Confidentiality

Both parties keep confidential information secret, also after the end of the agreement. [VERIFY: full text still to be taken over from the existing terms]

11. Force majeure

Neither party is liable for a failure caused by circumstances beyond their control, with emphasis on outages at cloud services and AI providers. [VERIFY: full text still to be taken over from the existing terms]

12. Changes

Launch Café may change these terms. Changes apply 30 days after notice by e-mail, unless the customer objects in writing or terminates within that period. [VERIFY]

13. Final provisions

Belgian law applies. The courts of the judicial district of East Flanders, division Ghent, have jurisdiction [VERIFY]. If a provision is void, the others remain in force and the void one is replaced by a valid one with the same purpose.
